If they think you have not taken adequate safety measures, they can prosecute. However, they may work with you to improve the situation and even give you time to improve, providing the risk is not endangering life.
As of October 1st 2023 it is a legal requirement that only competent persons who possess the required skills and knowledge can review your risk assessment.
